Chapter 10 What is a defect?
Generally, a defect under a construction contract is work which is not performed in accordance with the requirements of the construction contract. To assess what a defect is requires an examination of the terms of the contract to understand what was required of the contractor. Relevant provisions may include terms as to quality, workmanship, design, and materials as well as specifications and drawings. The principal and the contractor may also agree on a definition of defect.
