Breach of statutory duty

As well as being potentially liable for breach of contract or for breach of a duty owed under common law, a person may also be exposed to a claim for damages as a result of a breach of a statutory duty, such as a duty owed under the Australian Consumer Law. Where a person is entitled to make a claim for breach of a statutory duty, the calculation of damages for breach of a statutory duty will be calculated in accordance with that statute.
